Minutes

The meeting was called to order at 7:00 p.m. by Chairman Dale Donovan.  Selectmen in attendance included Michael May, Ira Wood and Helen Miranda Wilson.  Selectman Jerry Houk was absent.  Town Administrator Tim Smith also attended.

The Board held the following Shellfish Department public hearings consecutively.  Shellfish Constable Andy Koch was in attendance and presented his recommendations.  Wood read the public notice.
·       Application from Margaret Jennings and Laymon Clark to renew shellfish grant licenses #85C and #85CA for a ten year period – the Shellfish Constable recommended renewal.  On a motion by Wilson, seconded by Wood, the Board voted unanimously to renew shellfish grant licenses #85C and #85CA for a ten year period.
·       Application from Shawn Rose to renew shellfish grant licenses #85H and #85HA for a ten year period – the Shellfish Constable recommended renewal.  On a motion by Wood, seconded by Wilson, the Board voted unanimously to grant a ten year extension to Shawn Rose.
·       Application from Richard Blakeley to transfer shellfish grant licenses #85F, #85F-A and #85F-A ext. from Richard Blakeley to Richard Blakeley and Caleb Potter and to renew shellfish grant licenses #85F and #85F-A for a ten year period – the Shellfish Constable recommended that the transfers and renewals be approved.  On a motion by Wilson, seconded by Wood, the Board voted unanimously to add the name of Caleb Potter to shellfish grant licenses #85F, #85F-A and #85F-A ext.  On a motion by Wilson, seconded by May, the Board voted unanimously to renew shellfish grant licenses #85F and #85F-A for a ten year period.
·       Consider amending the Town of Wellfleet Shellfishing Policy and Regulations, Section 2.1 Definitions, Basket Rake – the Shellfish Constable noted that the proposed new language would clarify the regulations.  On a motion by Wilson, seconded by Wood, the Board voted unanimously to amend Section 2.1 Definitions, Basket Rake to read “A hand-held implement used for the harvesting of shellfish, which is similar to but longer than a standard clam hoe and which has a basket and no more than twenty (20) teeth, is no wider than 12 inches at its widest part, does not have a T handle, and is only to be used on foot.”
·       Consider amending the Town of Wellfleet Temporary Shellfish Regulations Section V, (Commercial and Non-Commercial Areas) by adding a second paragraph on “No Dragging” – on a motion by Wilson, seconded by Wood, the Board voted unanimously to add a second paragraph on “No Dragging” as follows:  “The area east of the No Dragging Line from the Candy Pole on Field Point to the boathouse on Lieutenants Island shall be closed to harvesting of shellfish by means of bullrakes, tongs, or any variation thereof, unless used on private licensed areas.”

May disclosed that he holds a commercial shellfish permit.

Announcements:
·       Wood announced that the Halloween parade is scheduled for Saturday, October 29th.
·       Wilson announced that tonight is the first night of the new expanded Library hours of Tuesday until 8 p.m., Saturday from 10 a.m.-5 p.m. and Sunday from 2-5 p.m. experimentally from November to April.
·       May invited the Board and the public to the opening of the new boat ramp at the Marina on October 28 at 1 p.m.
·       Donovan announced that the Historical Commission has published a book entitled “A Guide to Monuments, Memorials and Burial Grounds in Wellfleet, Massachusetts” and congratulated all those involved in the project.

The Board discussed:
a)  Town Administrator evaluation – discussion included the evaluation form, process and scoring.  On a motion by May, seconded by Wood, the Board voted 3-1, with Wilson voting against, to move forward with the process and form as was used last year.
b)  Coastal and Pond Access Committee – Tom Flynn was in attendance and outlined the issues relative to the West Meadow Ave. landing on Lt. Island.  He noted concern that the parking lot will be blocked off by the Audubon and people will pull off to the side of the road to park; that  funding may be needed and that a plan needs to be finalized for submission to the Conservation Commission.  Wood moved and Wilson seconded a motion to refer this matter to the Town Administrator and his staff for recommendation.  Discussion included creating a new landing, impact on Lt. Island residents and Fire Department access.  The Board voted unanimously in favor of the motion.
c)  Meeting date with Board of Water Commissioners – there was consensus to meet with the Board of Water Commissioners on November 17.
d)  Special Town Meeting – the Board discussed its message in the Special Town Meeting Warrant, several article explanations and scheduling a Pre-Town Meeting for November 22.
e)  Budget meeting schedule – Wood noted the value of joint budget meetings with the Finance Committee.  He moved and Wilson seconded a motion to schedule joint budget meetings as in the past.  It was suggested that fewer joint meetings be scheduled to allow more time for independent work by the Board of Selectmen and Finance Committee.  After discussion, Wood withdrew his motion with permission of the seconder.  There was consensus that the Town Administrator present a plan to the Board for budget presentations.
f)  Wilson suggested that the Fire Chief selection process be clarified at the next Board meeting and suggested listing executive sessions as a topic on the Board’s agendas.

Correspondence - Wood noted:
·       Letter from Building Needs and Assessment Committee regarding Special Town Meeting article recommendations.
·       Memo from the Wellfleet Fire Department regarding the vehicle policy for the Assistant DPW Director.
·       Letter from Nellie DiPinto regarding the cancellation of fire engine rides for Wellfleet Elementary School students – Interim Fire Chief Dan Silverman explained the reasons for the cancellation.

·       Letter from Dale Donovan to Mike Messina in response to letter about snow plowing issues.
·       Donovan noted the fax regarding the establishment of a Human Rights Commission for Barnstable County and that those interested in serving on the Commission should submit their name to Len Stewart of the Barnstable County Department of Human Services by October 28.

Open Session:
·       Bob Kelly addressed the Board regarding canoe space at Gull Pond.  May recommended that he contact the Beach Administrator.
·       The Town Administrator noted that a private citizen is going to land a helicopter at Indian Neck to pick up another Town resident for an aerial tour.

On a motion by Wilson, seconded by Donovan, the Board voted unanimously to accept the minutes of October 11, 2005 with one amendment.

On a motion duly made and seconded, the Board voted unanimously to adjourn at 9:10 p.m.
